3rd Party Acceptable Use Policy
OurWorld Meta has adopted this Acceptable Use Policy (AUP) to govern the use of its Website by its Customers (Users).
We are OurWorld Media Ltd. doing business as OurWorld Meta (Company, we, us, or our), a company registered in Ireland at OurWorld Media Ltd, 91 George’s Street, Lower Dun Laoghaire, Co. Dublin A96 T8K6. We operate the website https://ourworldmeta.io/ (the Site), as well as any other related products and Websites that refer or link to this Policy (collectively, the Websites).
A Customer is any party / person who uses this Website.
This OurWorld Meta acceptable usage policy (“AUP”) defines certain constraints relating to a customers or Third Party’s access to and use of OurWorld Meta Websites under any OurWorld Meta-related agreement (“Agreement”). The restrictions listed in this AUP are not all-inclusive. The meaning of any capitalised phrases used but not defined above is specified in the Agreement. OurWorld Meta retains the right to update this AUP at any time with reasonable notice, which may be conveyed through the OurWorld Meta Websites supplied or by posting an updated version of this AUP on the OurWorld Meta website.
Terms of Websites Use
The use of this Web Page by a Customer or Third Party is subject to the terms and conditions of any agreements entered into by such Parties and OurWorld Meta. This AUP is incorporated into such agreements by reference.
Use of our site includes accessing, browsing, or registering to use our site. Please ensure you have read and understood this policy. We recommend that you print a copy of this for future reference. If you do not agree to this policy, you must not use our site.
Updates to the AUP become effective thirty (30) days after publication or the date specified in the updated AUP, including for current users. Any modifications to the AUP contained in an update will only affect limits on OurWorld Meta Website use and access. Any violation of this AUP may result in the suspension or termination of your access to and use of the OurWorld Meta Websites.
You acknowledge that your actions in relation to the Web Page are exclusively your responsibility. You commit to following this Agreement’s rules and promise not to (and won’t try to): give OurWorld Meta inaccurate or misleading information and agree to:
- Interfere with or disrupt (or attempt to interfere with or disrupt) the OurWorld Meta Websites, or obtain (or attempt to gain) access to any Systems that link to them (unless as required to access and use the OurWorld Meta Websites appropriately);
- Use the OurWorld Meta web page to violate the security or integrity of, or otherwise abuse, any party’s System including but not limited to gaining unauthorised access to any System (including attempting to probe, scan, monitor, or test a System’s vulnerability), forging any headers or other parts of any message describing its origin or routing, interfering with the proper functioning of any System (including any deliberate attempt by any means to overload a System), implementing denial-of-service attacks, operating non-permissioned network Website (including open proxies, mail relays or recursive domain name servers), using any means to bypass System usage limitations, or storing, transmitting or installing malicious code;
- Use the OurWorld Meta Website to distribute or facilitate the sending of unsolicited or unlawful (i) email or other messages, or (ii) promotions of any kind;
- Use the OurWorld Meta Web Page to engage in or promote any other fraudulent, deceptive or illegal
Other Applicable Terms
Your use of our site is also subject to the terms of our Privacy and Cookie Policy, which outlines how we will handle any personal information you give us or that we obtain through other means. It also includes information on the cookies our Websites use. By using our site, you agree to the processing of your personal data and affirm that the information you have provided is accurate and will be updated as needed. Additionally, you reaffirm that you have the agreement of any third parties whose personal information you have submitted and that you will take equivalent steps to ensure that the information is correct and kept up to date.
Customer and User Responsibilities
Notice of Network Security Issues Customers and Users are entirely responsible for maintaining the confidentiality of password and account information, as well as the security of their network. Customers and Users agree to immediately notify OurWorld Meta of any unauthorised use of their accounts or any other breach of security known to you. If the Customer or User becomes aware of any violation of this AUP by any person, including Users that have accessed the Websites through Customers account, the Customer or User is required to notify OurWorld Meta.
Impending Security Event Notification All Users of OurWorld Meta Websites are responsible for notifying OurWorld Meta immediately if they become aware of an impending event that may negatively affect OurWorld Meta, its Websites or any of its Networks or Systems. This includes extortion threats that involve the threat of denial of service attacks, unauthorised access, or other security events.
When you use the Websites you warrant that you will comply with this Policy and with all applicable laws.
You also acknowledge that you may not:
- Systematically retrieve data or other content from the Websites to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Make any unauthorised use of the Websites, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.
- Circumvent, disable, or otherwise interfere with security-related features of the Website, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Websites and/or the Content contained therein.
- Engage in unauthorised framing of or linking to the Websites.
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
- Make improper use of our Websites, including our support Websites or submit false reports of abuse or misconduct.
- Engage in any automated use of the Websites, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- Interfere with, disrupt, or create an undue burden on the Websites or the networks or the Websites connected.
- Attempt to impersonate another user or person or use the username of another user.
- Use any information obtained from the Websites in order to harass, abuse, or harm another person.
- Use the Websites as part of any effort to compete with us or otherwise use the Websites and/or the Content for any revenue-generating endeavour or commercial enterprise.
- Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Websites, except as expressly permitted by applicable law.
- Attempt to bypass any measures of the Websites designed to prevent or restrict access to the Websites, or any portion of the Websites.
- Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Websites to you.
- Delete the copyright or other proprietary rights notice from any Content.
- Copy or adapt the Websites software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
- Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any partys uninterrupted use and enjoyment of the Websites or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Websites.
- Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (gifs/gifs), 1?1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as spyware or passive collection mechanisms or pcms).
- Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Websites, or using or launching any unauthorised script or other software.
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Websites.
- Use the Websites in a manner inconsistent with any applicable laws or regulations.
Inactive accounts:
If OurWorld Meta discovers an inactive account, the account may be suspended or cancelled, and any Customer Content associated with such an account may be erased. OurWorld Meta will give you at least 30 days’ notice (as required by the Agreement) before permanently deleting your account, unless we believe it is reasonable to suspend or terminate your account without notice. To avoid ambiguity, if we conclude that the email address connected with your account is invalid (for example, because it bounces after we notify you of inactivity), we may delete your account without further notice. An account may be considered inactive if:
- No Customer Authorised User has used OurWorld Meta Websites for at least six months;
- No Customer Instructional Input was ever created within or input into the account and at least three months has passed since the account was established; or
- If an account is set up to be paid by direct debit, the Customer (i) did not provide a valid bank account number and at least three months has passed without a valid account number being on file, provided that for the avoidance of doubt this provision does not limit OurWorld Meta right.
Information Security Requirements
Under OurWorld Metas Terms and Conditions all Customers and Third Parties are required under Agreement to ensure they have adequate and appropriate information security measures in place for the protection of their systems and data. From time-to-time OurWorld Meta will audit all parties under agreement to ensure such security protection measures are in place and appropriate to safeguard its own processes and those of its customers.
Linking to our Site
You are allowed to connect to our website as long as you do so ethically, legally, and without harming or exploiting our reputation. You may not create a link in such a way as to imply any kind of affiliation, acceptance, or recommendation by us when none exists. You are not permitted to link to our Websites from any Websites unless you obtain our permission to do so. Without prior warning, we have the right to revoke the link authorisation.
Suspension or Termination of Website Access
If Customers or Users engage in conduct or a pattern of conduct, including without limitation repeated violations by a User whereby correction of individual violations does not, in OurWorld Metas sole discretion, correct a pattern of the same or similar violations, whilst using the Website that violates the AUP, or is otherwise illegal or improper, OurWorld Meta reserves the right to suspend and/or terminate the the User’s access to the Websites.
OurWorld Meta will generally attempt to notify the Customer or User of any activity in violation of the AUP and request that the User cease such activity; however, in cases where the operation of OurWorld Metas Network is threatened or cases involving unsolicited commercial e-post/spam, a pattern of violations, post relaying, alteration of the Customer’s or User’s source IP address information, denial of service attacks, illegal activities, suspected fraud in connection with the use of Website, harassment or copyright infringement, the Company reserves the right to suspend or terminate the Websites or the User’s access to the Websites without notification.
We exclude liability for actions taken in response to inappropriate use of the site and any breaches of this policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
Limitation of Liability
Nothing in this Acceptable Use Policy limits OurWorld Metas rights and remedies (available at law or in equity) in any way with respect to any Prohibited Activity. OurWorld Meta shall fully co-operate with any law enforcement authorities or court order requesting or directing OurWorld Meta to disclose the identity or locate anyone posting any material in breach of this policy.
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content in it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use our site; or
- use of or reliance on any content displayed on our site.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on them, or on any Websites linked to them.
We assume no responsibility for the content of websites linked to our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
